CNOM evaluation report on the activities of the Physician-Industry Relations Department for the period 2020-2022 Some quantitative data

On February 2, a decree defined the format of the report to be sent to the Minister of Health by each competent authority concerning the implementation of the Loi Encadrement des avantages (LEA). All “competent authorities” under the terms of the LEA (Conseils de l’Ordre and ARS) were required to submit their reports by March 30. This week, the CNOM published its report on its website.

This meek, we present some quantitative data from the report.

First of all, we note the overwhelming majority of files submitted under the declaratory system (76% in 2022), as shown in the graph.

Over the 3-year period, we note :

  •  stability in the number of files submitted for authorization (16% to 17%)
  •  a proportional reduction in the number of declared cases, in favor of an increase in simplified agreements.

 

Processing agreements subject to declaration

29% of files submitted under the declaration procedure received a recommendation; although this percentage is significant, it is significantly lower than in 2021 (51%): this can be explained by the fact that, at the outset, the CNOM used recommendations as a tool for educational purposes, and that over the years, the educational effort has proved less useful.

Processing agreements submitted for authorization

In 2022, around 10% of files submitted for authorization were refused, a rate identical to that of the previous year.

It should also be noted that the CNOM issues an express authorization in more than half the cases.

Note: In our experience, the CNOM grants authorization before the regulatory 60-day deadline. Consequently, one time out of 2, the applicant can expect his or her file to be processed by the CNOM in less than 2 months.

Finally, to conclude the quantitative analysis of this report, two last very interesting figures for the year 2022:

  • 599 files submitted under the authorization system were the subject of an emergency processing request. This number is 20% higher than in 2021.
  • only 0.065% of benefit recipients are students, although the CNOM stresses that its data on students is not exhaustive.
